Terms and Conditions

1. SCOPE OF AGREEMENT

These Terms and Conditions apply to all users who:

• Register for an account on The Rookie Dance Studio Platform
• Book and participate in dance classes ("Classes") organized by The Rookie Dance Studio
• Use any features or services provided through the Platform

The Rookie Dance Studio is a non-profit Verein registered under Swiss law, dedicated to providing dance education and community activities.

2. USER ACCOUNTS AND REGISTRATION

2.1 Account Creation

• Users must provide accurate, current, and complete information during registration
• Users are responsible for maintaining the confidentiality of their account credentials
• Users must be at least 16 years of age to create an account independently. Users under 16 require parental or guardian consent

2.2 Member Types

• Adult Members: Standard membership for individuals 18 years and older
• Student Members: Discounted membership for verified students enrolled in educational institutions. Student status requires verification through upload of a valid student card and admin approval

2.3 Account Security

• Users are responsible for all activities conducted through their account
• Users must notify The Rookie Dance Studio immediately of any unauthorized use of their account
• The Rookie Dance Studio reserves the right to suspend or terminate accounts that violate these Terms

3. BOOKING AND ATTENDANCE

3.1 Class Bookings

Classes may be booked through the Platform subject to availability. Bookings can be made as:

• Single Class Booking: Pay-per-class attendance
• Subscription Booking: Using an active subscription (Monthly, 5-Times, or 10-Times card)

3.2 Booking Confirmation

• Upon successful booking, users will receive confirmation through the Platform
• Users are expected to arrive on time and prepared for the scheduled class

3.3 Venue Requirements

• Participants must bring clean training shoes with clean soles as required by the venue
• No eating is allowed inside the venue
• Participants must follow all venue rules and instructor guidance

3.4 QR Code Check-in

• Users must present their QR code (accessible via their profile) for check-in at each class
• Check-in validates attendance and deducts from subscription balance if applicable

4. FEES, PAYMENTS, AND SUBSCRIPTIONS

4.1 Class Fees

Contribution fees are set as follows:

• CHF 10 for verified student members
• CHF 15 for adult members and general public

4.2 Subscription Types

The Rookie Dance Studio offers the following subscription options:

• Monthly Card: Unlimited classes for 30 days from the selected start date
• 5-Times Card: Valid for 5 class check-ins with no expiration date
• 10-Times Card: Valid for 10 class check-ins with no expiration date

4.3 Payment Terms

• All fees and subscriptions are payable at the time of registration or booking
• Payments are processed securely through the Platform
• All payments are non-refundable except as required by law or at The Rookie Dance Studio's sole discretion

4.4 Subscription Management

• Only one active subscription is permitted per user at any time
• Subscription assignment and management are handled by authorized administrators
• Users can view their subscription status, remaining balance, and check-in history through their profile

5. CANCELLATION AND REFUND POLICY

5.1 User-Initiated Cancellations

• Bookings may be cancelled free of charge up to 24 hours before the scheduled class start time
• Cancellations made within 24 hours of the class start time will result in forfeiture of the full contribution fee or subscription credit
• Cancellations are not permitted within 24 hours of the class start time

5.2 Studio-Initiated Cancellations

The Rookie Dance Studio reserves the right to cancel or reschedule classes due to:

• Instructor unavailability
• Insufficient enrollment
• Venue issues
• Force majeure events (natural disasters, pandemics, government orders, etc.)

5.3 Refunds and Credits

In the event of a studio-initiated cancellation, participants may choose between:

• Credit toward future classes
• Full refund of the paid fee

Refunds will be processed within 14 business days.

6. ASSUMPTION OF RISK AND WAIVER OF LIABILITY

6.1 Acknowledgment of Risk

Participant acknowledges and understands that:

• Dance classes involve physical movement, exertion, and coordination
• Participation carries inherent risks including, but not limited to, muscle strains, sprains, falls, collisions, and other injuries
• Participant voluntarily assumes all such risks, whether known or unknown, foreseen or unforeseen

6.2 Waiver and Release

To the fullest extent permitted by Swiss law, Participant hereby:

• Waives any and all claims against The Rookie Dance Studio, its officers, board members, instructors, volunteers, agents, and representatives ("Released Parties")
• Releases the Released Parties from any liability, damages, losses, or expenses arising from participation in Classes
• Agrees not to hold the Released Parties responsible for personal injury, property damage, or any other harm, whether caused by negligence or otherwise

6.3 Indemnification

Participant agrees to indemnify and hold harmless the Released Parties from any claims, liabilities, damages, or expenses (including legal fees) arising from Participant's conduct, breach of these Terms, or violation of any law or third-party rights.

7. MEDICAL FITNESS AND INSURANCE

7.1 Physical Fitness

• Participant affirms that they are in adequate physical condition to participate in dance classes
• Participant has no medical conditions, injuries, or physical limitations that would prevent safe participation
• Participant is advised to consult a physician before beginning any physical activity program

7.2 Medical Disclosure

• Participants with known medical conditions, injuries, or concerns should inform instructors before class
• Instructors are not medical professionals and cannot provide medical advice

7.3 Personal Insurance

• Participant is solely responsible for obtaining and maintaining personal health and accident insurance
• The Rookie Dance Studio does not provide insurance coverage for participants
• Participant's insurance must cover any injuries or medical expenses incurred during participation

8. CODE OF CONDUCT

8.1 Expected Behavior

Participants agree to:

• Follow all instructor guidance and safety instructions
• Respect fellow participants, instructors, and staff
• Maintain a positive, supportive, and inclusive environment
• Refrain from disruptive, unsafe, or inappropriate behavior
• Respect venue property and equipment

8.2 Prohibited Conduct

The following behaviors are strictly prohibited:

• Harassment, discrimination, or bullying of any kind
• Use of offensive, abusive, or threatening language
• Intoxication or use of illegal substances
• Unauthorized recording or photography of classes or participants
• Any behavior that endangers the safety or well-being of others

8.3 Enforcement

Violation of the Code of Conduct may result in:

• Verbal warning
• Removal from class without refund
• Suspension or termination of account
• Legal action if warranted

9. INTELLECTUAL PROPERTY AND MEDIA RELEASE

9.1 Platform Content

• All content on the Platform, including text, graphics, logos, images, and software, is the property of The Rookie Dance Studio or its licensors
• Users may not reproduce, distribute, modify, or create derivative works without written permission

9.2 Photo and Video Release

By participating in classes and using the Platform, Participant grants The Rookie Dance Studio:

• Permission to capture photos, videos, and other media during classes, events, and activities
• A perpetual, royalty-free, worldwide license to use such media for promotional, marketing, educational, and archival purposes
• The right to use Participant's name, likeness, and voice in connection with such media

9.3 Opt-Out

Participants who wish to opt out of photo/video capture must notify The Rookie Dance Studio in writing at therookiestudio.ch@gmail.com. Opting out may limit participation in certain activities.

10. DATA PRIVACY AND PROTECTION

10.1 Data Collection

The Rookie Dance Studio collects and processes personal data including:

• Account information (name, email, date of birth)
• Profile data (avatar, student verification documents)
• Booking and attendance records
• Subscription and payment information

10.2 Data Use

Personal data is used solely for:

• Account management and authentication
• Class booking and attendance tracking
• Subscription management
• Communication regarding classes, updates, and announcements
• Student verification and member type determination

10.3 Data Protection

• All personal data is handled in compliance with Swiss Federal Act on Data Protection (FADP) and applicable regulations
• Data is stored securely using industry-standard encryption and security measures
• Data is not sold, rented, or shared with third parties except as required by law or with explicit consent

10.4 User Rights

Users have the right to:

• Access their personal data
• Request correction of inaccurate data
• Request deletion of their data (subject to legal retention requirements)
• Withdraw consent for data processing

11. PLATFORM USE AND RESTRICTIONS

The Platform is provided for personal, non-commercial use to register and manage user accounts, book and manage class attendance, view subscription status and check-in history, and access profile and QR code for check-in.

Users may not use the Platform for any unlawful purpose, attempt to gain unauthorized access, interfere with functionality, use automated systems, impersonate others, or share account credentials.

12. MODIFICATIONS TO TERMS

The Rookie Dance Studio reserves the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to the Platform. Users will be notified of material changes via email or prominent notice on the Platform.

13. TERMINATION

Users may terminate their account at any time by contacting The Rookie Dance Studio. The Rookie Dance Studio reserves the right to suspend or terminate user accounts for violation of these Terms, fraudulent activity, or abusive behavior.

14. LIMITATION OF LIABILITY

To the fullest extent permitted by Swiss law, The Rookie Dance Studio's total liability for any claim shall not exceed the amount paid by the User in the 12 months preceding the claim. The Rookie Dance Studio is not liable for indirect, incidental, consequential, or punitive damages.

15. DISPUTE RESOLUTION AND GOVERNING LAW

These Terms and Conditions are governed by and construed in accordance with the laws of Switzerland. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in the canton where The Rookie Dance Studio is registered.

16. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

17. ENTIRE AGREEMENT

These Terms and Conditions, together with the Privacy Policy, constitute the entire agreement between the User and The Rookie Dance Studio regarding use of the Platform and services.
